Thank you for choosing SnapSale, a mobile point of sale (POS) platform designed to streamline business transactions. By creating an account or using the app, you agree to the following terms and conditions:
1. Acceptance of Terms
By downloading, installing, and using SnapSale, you agree to comply with this User Agreement and any applicable laws and regulations. If you do not agree with these terms, please do not use the app.
2. Account Registration
Users (individuals or businesses) must create an account to access and use SnapSale. During registration, you will provide personal and business information. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account.
3. Transaction Processing
SnapSale allows users to perform calculations for customer transactions, generate sales receipts, and facilitate exchanges and trade-ins. Users can trade in items to receive credits or cash. You agree to ensure all transaction data is accurate and that all exchanges and sales comply with applicable laws.
4. Sales Records and Inventory Management
As part of using SnapSale, sales records are automatically created and stored to help sellers track their sales volume and statistics. Users can also add, manage, and track inventory within the app. You are responsible for maintaining accurate records of your sales and inventory.
5. Data Storage and Privacy
Personal and business information may be collected and stored as part of the app’s features. However, we do not share personally identifiable information (PII) with third parties without your explicit consent, unless required by law. We take reasonable measures to protect the security of your data.
6. Trade-In Items
Users have the ability to trade in items, which can either be credited against a purchase or exchanged for cash. The value of trade-in items is determined by the business using SnapSale. All trade-in transactions must adhere to the policies established by the business.
7. Fees and Payments
SnapSale may charge fees for certain services or features. By using the app, you agree to any applicable fees, as communicated at the time of service usage. All payments processed through SnapSale are subject to the terms of the payment provider, and SnapSale does not assume liability for any payment processing issues.
8. User Conduct
You agree to use SnapSale in a manner that is lawful and does not infringe upon the rights of others. You are prohibited from using the app to:
- Commit fraud or unauthorized transactions
- Engage in any illegal activities
- Distribute harmful or malicious content
- Violate the privacy of others
- Use the app for commercial purposes without authorization
9. Data Retention and Deletion
You can request the deletion of your account and associated data at any time. However, SnapSale may retain certain transaction or business records as required by law or for legitimate business purposes.
10. Limitation of Liability
SnapSale is provided on an “as-is” basis. We do not guarantee the app will be error-free or uninterrupted. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from the use of SnapSale.
11. Changes to Terms
We reserve the right to modify this User Agreement at any time. You will be notified of significant changes, and continued use of SnapSale after such changes indicates acceptance of the new terms.
12. Termination
We reserve the right to terminate or suspend your account if you violate this User Agreement or engage in prohibited conduct.
13. User-Uploaded Photos and Content
As part of using SnapSale, you may have the option to upload photos or other content (e.g., product images, trade-in item photos, or business logos) to enhance your inventory management, transactions, or business profile. By uploading any content, you agree to the following terms:
Ownership
You retain ownership of any photos or content you upload to the app. However, by uploading content, you grant SnapSale a non-exclusive, royalty-free, worldwide license to use, display, and store the content for purposes directly related to providing the app’s services (e.g., displaying product images to customers during transactions).
Permissions
You represent that you have all necessary rights and permissions to upload any content and that it does not infringe upon the intellectual property rights, privacy rights, or other legal rights of any third party.
Prohibited Content
You agree not to upload any content that:
- Contains explicit, illegal, or offensive material
- Violates the rights of others
- Includes personal information about other individuals without their consent
- Is harmful, misleading, or deceptive
Content Removal
SnapSale reserves the right to review, remove, or disable access to any user-uploaded content that violates this agreement or is deemed inappropriate at its sole discretion, without prior notice.
Responsibility
You are solely responsible for the accuracy and legality of the content you upload. SnapSale is not liable for any content uploaded by users or any actions resulting from the display or use of such content.
14. Calculation Accuracy Disclaimer
SnapSale provides a calculator as part of its point of sale (POS) features to assist users in processing transactions, trade-ins, and other calculations. While we strive to ensure accuracy, SnapSale does not guarantee that all calculations will be error-free. Users are responsible for verifying the accuracy of all calculations before finalizing transactions.
SnapSale is not liable for any errors, miscalculations, or financial losses resulting from the use of the calculator. By using this feature, you acknowledge that you assume full responsibility for reviewing all transaction details and ensuring correctness before proceeding.
In addition to the above terms, by creating an account or using the app you also agree to Apple Terms of Use (EULA)
By using SnapSale, you acknowledge that you have read, understood, and agree to this User Agreement.
